Lawsuits Expedite Pesticide Registration in Brazil

However, the time to obtain a product registration (technical + formulated) takes 7 to 12 years, and can even surpass 18 years.

Considering that it is possible to carry out up to three harvests per year, and taking into account 7 years for a registration approval, this period is equivalent to 21 harvests. In the meantime, resistance to the active ingredients may arise, which may lead products pending registration to become obsolete; or they may no longer have the same demand as 7 years earlier, at the time the company applied for registration.

For this reason, companies are increasingly resorting to lawsuits to speed up the registration process. This is based in the Law that establishes deadlines for evaluation conclusions. If the deadlines have not been met by the regulatory agencies, Ibama, Anvisa and the Ministry of Agriculture, they will be subject to lawsuits by the registrant company to ensure that the deadlines are met.

The total of Chemical Formulated Products with evaluations [by Ibama and/or Anvisa] approved through lawsuits in 2024 was 103, with 27 products approved through lawsuits by both agencies during the period. In 2023, there were 73 approvals through lawsuits, while  29 products were approved through lawsuits by both agencies in the same year. Approved registrations mean faster market access.

In 2024, the companies that stood out with the most evaluation approvals of Formulated Chemical Products through lawsuits were Rainbow (11), Cropchem (10), Adama (7), Proregistros (7), representing 34% of the total.

As the global pesticide market becomes more competitive, which it has in recent years, foreign companies are increasingly focusing on Brazil, as it is a market with large volumes, extensive agricultural areas, advanced technology, and up to three annual harvests. The main gateway to accessing this market is through product registration. The longer the time for registration approvals, the more lawsuits become part of the regulatory process, reaching 30-35% of approvals of generic product registrations, according to a survey carried out by AllierBrasil. This, however, is a great disincentive for companies that chose conventional procedures to register their products, as, at the very least, they lose competitiveness.

In this way, the increase in lawsuits forms a vicious circle that can only be surpassed by reducing the time for registration approvals or by changing the legislation, reviewing the definitions of deadlines for completing evaluations
